PRIVACY NOTICE related to personal data collected by QUALY PANEL, S.A. DE C.V. (hereinafter referred to as “QUALY PANEL”)

1.- General.

1.1.- QUALY PANEL IS A COMPANY COMMITTED TO AND RESPECTFUL OF THE RIGHTS OVER THE PERSONAL DATA OF INDIVIDUALS, RECOGNIZED IN ARTICLE 16 SECTION II OF THE POLITICAL CONSTITUTION OF THE UNITED MEXICAN STATES, AS WELL AS THE PROVISIONS OF THE FEDERAL LAW OF PROTECTION OF PERSONAL DATA IN POSSESSION OF INDIVIDUALS, THEREFORE, MAKES AVAILABLE THIS PRIVACY NOTICE, IN ORDER THAT THE OWNER OF THE PERSONAL DATA, IS EMPOWERED TO EXERCISE HIS RIGHT TO INFORMATIONAL SELF-DETERMINATION.

1.2.- WHEN ENTERING AND USING THIS INTERNET PORTAL, WHOSE DOMAIN NAME IS: www.covintec.com OWNERSHIP OF QUALY PANEL, YOU (THE HOLDER) DECLARE THAT YOU AGREE TO ACCEPT THE TERMS AND CONDITIONS CONTAINED IN THIS NOTICE AND EXPRESSLY DECLARES AND GRANTS ITS ACCEPTANCE AND CONSENT USING ELECTRONIC MEANS FOR SUCH PURPOSE, IN TERMS OF THE PROVISIONS OF ARTICLE 1803 OF THE FEDERAL CIVIL CODE.

1.3.- IF THE HOLDER DOES NOT FULLY AND COMPLETELY ACCEPT THE TERMS AND CONDITIONS OF THIS NOTICE, HE/SHE MUST REFRAIN FROM SHARING ANY TYPE OF INFORMATION TO QUALY PANEL BY ANY MEANS, INCLUDING THE SITE: : www.covintec.com

1.4.- IN THE EVENT THAT THE LICENSEE CONTINUES IN THE USE OF : www.covintec.com WHETHER IN WHOLE OR IN PART, SUCH ACTION SHALL BE DEEMED YOUR ABSOLUTE AND EXPRESS ACCEPTANCE OF THE PRIVACY NOTICE.

1.5.- THE SOLE USE OF THE WEBSITE BY THE PUBLIC OWNER (HEREINAFTER REFERRED TO AS THE “OWNER” OR THE “OWNERS”) IMPLIES THE FULL AND UNCONDITIONAL ACCEPTANCE OF EACH AND EVERY ONE OF THE GENERAL AND PARTICULAR CONDITIONS INCLUDED IN THIS PRIVACY NOTICE IN THE VERSION PUBLISHED BY QUALY PANEL, AT THE VERY MOMENT THE OWNER ACCESSES THE PAGE.

THE PARTIES AGREE THAT IN THE ABSENCE OF ERROR, FRAUD, MALICE, BAD FAITH OR ANY OTHER DEFECT OF WILL THAT COULD NULLIFY THE VALIDITY OF THIS INSTRUMENT, BOTH PARTIES AGREE TO BE BOUND BY THE PROVISIONS OF THE FOLLOWING:

2.- Definitions

2.1.- Holder– The natural person (HOLDER) to whom the personal data identifies or corresponds.

2.2.- Sensitive personal data: Those personal data that affect the most intimate sphere of their owner, or whose improper use may give rise to discrimination or entail a serious risk for the owner.

2.3.- Controller. Natural or legal person (QUALY PANEL) of a private nature that decides on the processing of personal data.

2.4.- Person in charge: The individual or legal entity that alone or jointly with others processes personal data on behalf of the controller.

2.5.- Processing– The collection, use (including access, handling, use, exploitation, transfer or disposal of personal data), disclosure or storage of personal data by any means.

2.5.1 Transfer:Any communication of data to a person other than the person responsible for or in charge of the processing.

2.6.- ARCO Rights– Rights of access, rectification, cancellation and opposition.

2.7.-Tacit consent: It will be understood that the owner has consented to the processing of the data, when the Privacy Notice has been made available to him/her and he/she does not express his/her opposition.

2.8.-Primary Purposes – Those purposes for which the personal data are mainly requested and for which the relationship between QUALY PANEL and THE OWNER is created.

2.9.-Secondary Purposes– Those purposes that are not essential to the relationship between QUALY PANEL and THE HOLDER, but whose processing contributes to the fulfillment of QUALY PANEL’s corporate purpose.

3.-Identity and address of the person in charge.

QUALY PANEL S.A. DE C.V. is responsible for the collection of personal data.who agree to respect the provisions of this Privacy Notice (hereinafter the “Notice”), which is made available to you in compliance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals (hereinafter the “Law”) and is applicable with respect to the personal data of individuals, who QUALY PANEL obtains from its activities with applicants, employees, customers, prospective customers, suppliers, prospective suppliers and/or business partners or service providers, visitors to the facilities, and users of the website:www.covintec.com

The address established by QUALY PANEL for the purposes of this notice is located at: Bosque de Alisos number 21, Col. Bosques de las Lomas, Delegación Cuajimalpa de Morelos, Mexico City, Distrito Federal, C.P. 05120.

4.- Data collected.

THE HOLDER acknowledges and accepts that QUALY PANEL, will directly obtain the following personal data, according to the relationship with each HOLDER:

Candidates or Workers. Full name, date of birth, e-mail address, home address conventional, marital status, signature, photograph, local and/or cell phone, social security number, fax, CURP, RFC, driver’s license number, school level. Contact information in case of emergency, date and time of entry and exit to QUALY PANEL facilities. Personal references or contact information (name, address, telephone number and company where you work). School data. Last degree, institution, generation, average, degree received, current studies, schedule and institution, office functions mastered, courses or seminars, institution and date of application of such courses, knowledge of languages and computer and office equipment and availability to travel.professional experience. Company, line of business, telephone, period, last salary, name and position of last immediate supervisor. Documentation in copy: Birth certificate, CURP, IFE, proof of address, proof of studies, Curriculum Vitae and two personal references.

Client. Name, CURP, RFC, account statement, contact information and positions, area, fixed and cell phones, e-mails and signature.

Copy of documentation: IFE, Financial Statements, R1 (registration), copy of RFC, proof of address, annual tax return, commercial and/or personal references.

Prospective Suppliers and Service Providers. Fiscal data and e-mail, full name, date of birth, landline and cell phone, address, profession, education and languages (spoken and written).

Documentation. Official identification, RFC, bank statement, tax registration, (R1).

Website User: Contact Section. Name, telephone, e-mail, country, state, and city. Job opportunities section. Name, schooling, area, e-mail, mobile and landline phone, area of experience and economic pretension.

4.2. THE HOLDER hereby grants express consent in terms of Article 9 of the LFPDPPP, so that QUALY PANEL, treat your personal, financial and / or property data contained in this clause, to fulfill the purposes set forth in this Privacy Notice.

4.3. QUALY PANEL states that it may obtain the personal data of THE OWNER through the so-called public access sources, in order to validate, update and contact THE OWNER, respecting at all times the reasonable expectation of privacy, referred to in Article 7 of the LFPDPPP.

4.4. QUALY PANEL will use IP (Internet Protocol (Internet Protocol) information to analyze any threats to the site: www.covintec.com, as well as to gather demographic information. However, IP information will in no case be used to identify the OWNERS, except where there is a likelihood of fraudulent activity.

5.- Use of “Cookies” and “web beacons”.

5.1.- QUALY PANEL recognizes that it is not possible for the site: www.covintec.com make use of cookies in connection with certain features or functions. Cookies are specific types of information that a Web site transmits to the OWNER’s computer hard drive for record-keeping purposes. Cookies may serve to facilitate the use of a website by saving passwords and preferences while THE HOLDER is browsing the Internet.

5.2.- The site: www.covintec.com does not use or store cookies to obtain personally identifiable information from the OWNER’s computer that was not originally sent as part of the cookie.

5.3.- Web beacons are images inserted in a web page or e-mail, which can be used to monitor the behavior of a visitor, such as storing information about the IP address of the user, duration of interaction time on that page and the type of browser used, among others.

5.4.-Although most browsers accept “cookies” and “web beacons” automatically, THE HOLDER can configure his/her browser not to accept them. To disable “cookies”, follow the instructions below:

6.- Purposes of personal data processing.

6.1 QUALY PANEL accepts and acknowledges that it may process directly or through its representatives, the personal data of THE OWNER, in accordance with the type of relationship it has with him/her, for the following primary purposes:

a) THE OWNER – Employee and Candidates.
To contact THE HOLDER, by any means in order to follow up and evaluate the experience and studies of THE HOLDER, to know the feasibility of being selected and the possibilities of success in the position he/she intends to perform.
Create a file of THE HOLDER that will be kept in the Human Resources offices of QUALY PANEL, for up to 6-six months, in case he/she is not selected for the position he/she intends to perform.
Create a file of THE HOLDER that will be kept in QUALY PANEL‘s offices, which may be physical and/or digital.
To carry out the necessary procedures for registration, cancellation or modifications to the registration of THE HOLDER-Worker, before the Mexican Institute of Social Security and/or the institutions required.
To carry out the necessary procedures to obtain the debit card, for the deposit of salary and/or commissions, and other benefits generated in favor of THE EMPLOYEE.
To carry out the process of payment of salary and benefits of THE EMPLOYEE, as well as discounts of alimony required by court order.
Keeping track of attendance through fingerprint records.
Manage with airlines and hotels the business trips required by the EMPLOYEE-HOLDER.
To issue the labor certificates required by the EMPLOYEE-HOLDER.
Enroll the EMPLOYEE in courses, seminars, workshops, or any other type of training organized by third parties, related to the activities or line of business of QUALY PANEL.
Issuance of certificates of participation in courses, seminars or workshops organized by QUALY PANEL.
Elaboration of letters or contracts for the assignment of work tools required by the OWNER-Worker for the execution of their work activities.
Exhibit the file of the HOLDER, to prove compliance with the processes in accounting audits, which are performed periodically to QUALY PANEL by third parties certified in the corresponding field.

b) THE OWNER-Customers and/or Prospective customers

To process credit lines, and to make the necessary arrangements for them, at the customer’s request.
Contact you by telephone or e-mail, to attend and follow up on requests for services or products.
Give attention and follow-up to sales through internet portals and exhibitions.
Register them and update the data in the internal systems, for access to personal data by the persons authorized to do so.
Make and store a physical file of the Holder-Customer for the duration of the business relationship and for up to 10-10 years after termination.
Preparation of electronic invoicing and credit notes derived from the products marketed. QUALY PANEL.
To carry out transactions with credit institutions resulting from commercial operations.

c) THE HOLDER–Supplier and/or Prospective Supplier.
To register the Supplier‘s profile in the internal systems for internal access to personal data by the persons authorized to do so.
Contact you by telephone or e-mail, to follow up on requests for services and/or products required by QUALY PANEL.
Make bank transfers, and rectification of data, on the occasion of product requisitions made by QUALY PANEL.
Make clarifications on payments.
Keep a physical and/or electronic file of the Supplier for the duration of the commercial relationship and for 10-10 years after its termination for any reason.
d) THE OWNER –VISITOR
Identify visitors on QUALY PANEL premises.
Conduct videotaping at all facilities, which will be retained for 1-calendar month.
To carry out directly or through the person in charge the registration of the entrance and exit of visitors to its facilities.
Store in a database the registration data for entries and exits of QUALY PANEL facilities, for a period of 3 to 3 months from the date of registration.

e) THE OWNER – User
Contact by any means to THE OWNER-User, to attend and follow up on their comments or requests in the “Contact” and “Job Opportunities” sections of the website.
Store personal data in internal systems for the duration of the relationship with QUALY PANEL and for 1 – 1 year thereafter.

6.2. QUALY PANEL may process the OWNER’s personal data for the following secondary purposes:

For the case of the CUSTOMER, to evaluate the quality of the services and/or products offered by QUALY PANEL, as well as the quality of attention to their comments or requests.
Conduct internal studies on consumption habits.
To provide you with additional communications, information and promotions, such as newsletters and invitations to events or greetings.
Inform via email about changes or new products that are related to the product requested by the HOLDER.
To contact the OWNER-Userto inform him/her of updates to the Website, informational and service-related messages, including important security updates.
Generate internal reports on the use of the Web Site:www.covintec.com.
Massive mailings of mail marketing.
In the case of THE EMPLOYEE-HOLDER, to provide references about his/her performance and personal characteristics of THE EMPLOYEE-HOLDER, either to future employers or lending institutions, up to a period of 5-five years after the termination of the employment relationship.
In the case of THE EMPLOYEE-HOLDER, to send communications by any means of advertising or discounts offered by third parties to QUALY PANEL EMPLOYEES-HOLDERS.
In the case of THE EMPLOYEE-HOLDER, the contracting with third parties of life insurance or major medical insurance offered to QUALY PANEL EMPLOYEES-HOLDERS.

6.3.- In the event that the holder does not wish his personal data to be used for all or some of the Secondary Purposes set forth in section 6.2., he must send a request for deletion of his data, specifying the purposes for which he does not wish his personal data to be processed, to the following e-mail address:

6.4.- Likewise, QUALY PANEL hereby informs the OWNER that, except for the exceptions described in points 6.1 and 6.2 of this Notice, all personal data stored on physical media will be stored for up to 5-five years, once the purpose for which they were collected has concluded, for their subsequent destruction. In the case of information contained in electronic media and for which a storage term is not established, the term will be up to 10-10 years after the conclusion of the purpose for which they were collected.

7.- Limitations on access and disclosure of personal data.

QUALY PANELThe COMPANY, is committed to make its best effort to protect the security of the personal information that THE HOLDER is providing, through the execution of legal acts, the use of technologies that control the access, use or unauthorized disclosure of personal information; for this purpose, personal information is stored in databases with limited access that are located in controlled facilities with security mechanisms; QUALY PANEL, undertakes that the information provided by THE HOLDER will be considered confidential and used under full privacy.

In this regard, QUALY PANEL is obliged to take the necessary measures to ensure that the persons in charge it uses comply with the provisions of this Privacy Notice.

8.- Responsible for processing the applications.

In case THE HOLDER needs to revoke his/her consent, as well as Access, Rectify, Cancel, Oppose the processing of the personal data he/she has provided, he/she must do so through the person designated by QUALY PANEL, whose details are described below:

9.- Means to revoke consent.

THE OWNER of the personal data may revoke the consent given with the acceptance hereof. Such revocation of consent granted by electronic means shall be made by observing the following procedure:

9.1.- To send an e-mail to the attention of the Responsible, designated in point 8-eight of this Notice, by means of which such requests will be met.

9.2.-Send a request or data message to the e-mail address specified above, indicating:

9.2.1.- The full name of the OWNER, address and e-mail address to receive the response generated as a result of the request;

9.2.2.- The reason for your request;

9.2.3.- The arguments supporting your request or petition;

9.2.4.- Official document that accredits his/her identity and proves that he/she is who he/she says he/she is; and

9.2.5.- Date as of which the revocation of your consent becomes effective.

9.3.- QUALY PANEL shall notify THE OWNER, within a maximum period of 20 (twenty) days from the date on which the request for the exercise of the ARCO rights was received, the resolution adopted, so that, if it is appropriate, the same becomes effective within 15 (fifteen) days from the date on which the response is communicated, by means of a message containing that it has executed all acts aimed at not processing THE OWNER’s personal data.

10.- Means to exercise ARCO rights.

In case THE HOLDER needs to Access, Rectify, Cancel or Oppose the personal data he/she has provided to QUALY PANEL, THE HOLDER shall follow the following procedure:

Send an e-mail to the attention of the person in charge, designated in point 8-eight of this Notice, by means of which said requests will be attended to, indicating the following:

10.2.1.- The full name of the OWNER, address and e-mail address to receive the response generated in connection with the request;

10.2.2.- The reason for your request;

10.2.3.- The arguments supporting your request or petition;

10.2.4.- Official document that accredits your identity and proves that you are who you say you are;

10.2.5.- A clear and precise description of the personal data with respect to which it seeks to exercise any of the ARCO rights, and any other element or document that facilitates the location of the personal data.

10.2.6.- In the case of requests for rectification of personal data, the OWNER shall indicate, in addition to the aforementioned, the modifications to be made and provide the documentation supporting his/her request.

10.3.- QUALY PANEL shall notify the OWNER, within a maximum period of 20 (twenty) days from the date on which the request for access, rectification, cancellation or opposition was received, the resolution adopted, so that, if appropriate, the same is made effective within 15 (fifteen) days from the date on which the response is communicated. In the case of requests for access to personal data, the delivery shall be made upon proof of the identity of the applicant or legal representative, as appropriate.

11.- Transfer of personal data.

QUALY PANEL will transfer the personal data of the OWNER to third parties, both public (IMSS, FONACOT, INFONAVIT and SAT) and private entities (banking institutions), in cases where it is necessary to comply with the purposes set forth in this Privacy Notice.

THE HOLDER accepts and acknowledges that if you do not express your opposition to the transfer of your data, it will be understood that you have given your consent to do so.

Notwithstanding the foregoing, and in the event of security breaches occurring at any stage of processing, which significantly affect the economic or moral rights of the OWNERS, they will be informed immediately by e-mail, in order for the latter to take the corresponding measures to defend their rights, releasing from any responsibility to QUALY PANEL, if the violation is not attributable to him.

12.- Modifications.

The parties agree that the Privacy Notice may be modified at such time and in such manner as the parties may determine. QUALY PANELdetermines it, according to the study and the regulations on the protection of personal data arise, so it is obliged to keep updated the same, for consultation on the site, whose URL is: www.covintec.com, in order that, if applicable, THE OWNER is able to exercise his/her ARCO rights.

13.-Applicable law and jurisdiction.

The parties express that this notice shall be governed by the legal provisions applicable in the Mexican Republic, in particular, by the provisions of the Federal Law of Personal Data in Possession of Individuals and its regulations.

In the event of a dispute or controversy arising out of the interpretation, execution, or performance of the In such case, the parties will seek to reach an agreement within a period of thirty (30) calendar days from the date on which any difference arises and the other party is notified in writing of such event, deducting the mediation process before the Alternative Justice Center of the Federal District, being carried out under the Alternative Justice Law of the Superior Court of Justice of the Federal District and its Internal Regulations, in force at the time the dispute arises.

In the event that the parties do not reach an agreement, they hereby agree to submit all disputes arising from the present NOTICE or any of the documents derived therefrom, or that are related to this or those, shall be definitively resolved and are subject to the jurisdiction and laws of the Federal Administrative Authorities or the Courts of Mexico City, Federal District, expressly waiving any other jurisdiction that may correspond to them due to their present or future domiciles.
